Babeloo International Corporation SL located in Via Augusta 236, 08021 Barcelona – Spain, registered in Barcelona RCS   n°B-64101819, exploits the Babeloo trademark registered in several European countries, as well as the URLs: Babeloo.com, Babeloo.es and Babeloo.ma
The hereon contract rules the conditions of use of Babeloo website and/or of one our distribution channels: travel agencies, operators, tourism offices, etc…as well as the conditions of sale and the terms of purchasing of the services we provide.
The reservation requests and reservations made through Babeloo website comply with the herein below mentioned General Conditions of Sales.
We invite you to read carefully the general conditions of sale applied to the reservations made.

General Conditions of sale.

The general conditions of sale set the agreement that regulates the relation between Babeloo and the customer/web user, during and after the purchase of a service, through the Babeloo website.
In order to purchase a service through Babeloo website, you must agree with the general conditions of sale.  Herebelow the term: “the establishment”,  stands for “the establishment operator of an establishment: hotel, Riad, Kasbah, villa apartment or guest house”

1. Babeloo acts as a distribution agent for all the “Establishments” hereinabove mentioned.  Therefore, the agreement is signed by the customer/web user and the Establishment.
In general, the contract between the customer and the Establishment will be regulated by supplementary terms.
Before validating the transaction, it is highly important to be familiar with the general conditions of sale applied by “the Establishment”.
These conditions are explained in the descriptive page of the selected service.
When acting as a distribution agent, Babeloo has no contractual obligation with the customers when it comes to this service.
Babeloo can not be hold responsible for possible errors in the tarifs which are published on its website.

2- The service contract is signed by you and the Establishment. Further questions or requirements for supplementary information should be asked directly to the Establishment, through the Babeloo platform.  You will receive a confirmation all the information needed in order to contact the Establishment (email, mail or phone number)

3- The services offered in Babeloo, are valid during a period of time.  Therefore, it is your responsibility to check if the date of the service is valid. It is important that you check the validity of our offers
4 – Babeloo has the right to provide the Establishment with your credit card information (or any other way of payment) and with information needed in order to perform your reservation.

5- It is your responsibility to know the canceling conditions considered by the hired service.

6- You are responsible for the veracity of the provided information, especially the information related to your credit card.  You must own the credit card used to hire the service, and the bank account should have enough funds to cover the amount of the service.

7- You are responsible to report Customer Service, in case of any possible change in the information provided to make the reservation.

8- Babeloo can not forbid you to make incoherent reservations, such as booking several rooms for the same night, or in two different cities.  It is your responsibility to check the coherence of your reservations.

9- Babeloo commits itself to do its best to correct any possible mistake or omission after being provided with your personal information.

Due to the complexity of the technology used  by Babeloo, errors may occur. These errors may change the reservation price, a service or any other information related to the Establishment.  In that case, Babeloo reserves the right to cancel the contract, releasing you of any financial consequence.

10- Babeloo uses a safe technology for the payments SSL in order to guarantee the confidentiality and security of your reservations.

General Conditions of Babeloo Reservations.

The General Conditions of Reservation apply to all the Establishments.

1- The “public price” (TAX included), is the price established by the operator of the establishment.  That is the highest price allowed to bill for a room, suite or rent for the whole Establishment.  Free of stay taxes and domestic taxes that will be informed to the guest in the regulations of your stay.
2- All the promotions, special offers and last minute offers on the Babeloo website, are estimated according to the current public price, in the moment of the promotional offer online.  You must consider that sometimes not all the taxes are included by the Establishment in the public price.  In that case, that information will be provided on the site of the Establishment or during the procedure of reservation.
3- A warranty deposit that will represent a percentage of the total cost of your stay will be withdrawn from the credit card used to make the reservation.  The remaining percentage should be paid in the Establishment during your stay.  Reservations are not confirmed until the deposit is successfully withdrawn from your account.

4-Reservation change

To change a reservation, the customer should contact the reservation service of Babeloo, by email: reservation@babeloo-maroc.fr , attaching a printed copy of the confirmation email.
The change of a confirmed reservation (already paid), will have an extra charge of 15 euros.  Of course, the request for reservation changes depends on the availability of the Establishment, and can influence on the price.

5-Cancelations

In order to cancel a booking, the client should send an e-mail to reservation@babeloo-maroc.fr requesting a cancellation, with the confirmation message from Babeloo attached.

All bookings accepted by Babeloo are subject to the particular cancellation conditions imposed by the accommodation in question, as explained in the accommodation information.
If there are no particular cancellations imposed by the accommodation chosen, then Babeloo will apply the following default conditions:
- If a booking is cancelled more than one month before the arrival date, your deposit will be returned to you minus 5% of the entire cost of the booking to cover cancellation charges.
- If a booking is cancelled more than seven days in advance of arrival (but less than one month before) your deposit will be returned to you minus 20% of the entire cost of the booking.
- If a booking is cancelled less than seven days in advance of arrival your deposit will be returned to you minus 30% of the entire cost of the booking.
- If the client fails to arrive without having previously cancelled his or her booking (“no show”), he/she will be charged the full 100% of the total cost of the booking.

6– In order to avoid any inconvenient we strongly recommend our customers to print the confirmation of their reservation.  In case of an early departure of the Establishment, it doesn’t matter the reason, Babeloo will not return the warranty deposit paid in the moment of the reserve confirmation.

7- The prices established refers to one room only, TAX included, (unless otherwise indicated) and is generally based on a double stay (unless otherwise indicated).  The total price of the stay is indicated during the process of booking.

8- The photographs of the rooms are informative only, and doesn’t correspond to the service selected.

9- Breakfast is generally included in the price of the room.  However, certain Establishments, bill it separately.  Lunch and dinner are not generally included in the price of the room.  The meals included are detailed in the Establishment information and in your reserve confirmation.

10- Notice that the prices indicated for the rooms, suites and riads are in euros, unless otherwise indicated.  The warranty deposit is also charged in euros.  The rest can be charged in euros or in domestic money (Dirham).  It depends of the owner.

11- The information about the Establishments in Babeloo website, indicates the services included in the price as well as information related to a specific establishment (or a specific service)

12- In order to assure the best quality for our guests, the establishments offered on the web site are regularly visited by our staff.

13 – The herein above mention services generally are not included in the mentioned prices: insurance, cancellation, trips, restaurant, stay taxes, domestic taxes, supplementary expenses, such as tips, or personal expenses (dry cleaner, phone call, fax, and internet)

14- Prices are estimated according to the amount of nights, and not according to days.  The amount of nights corresponds to the period of time that the room will be at the customer’s disposal.

15- If a Establishment has overbooked the same room during the same period of time (overbooking), the owner is responsible and must pay for another establishment, in an area of the same or better category, and in a room of the same category or better.  The money difference should be afforded by the owner.

16- The kind of room, selected during the process of booking, could be changed by the Establishment, in case of an exceptional situation: registered customers that extend their stay and/or refuse to leave the room, or furniture or fitting problems in the selected room, etc..
The owners will do their best to provide the customer with the selected service.

17- During the process of booking, the customers are invited to inform the arrival time.  It is important to communicate any change in the arrival time to the owner.

Intellectual and industrial property.

All the content, brands, logos, drawings, photographs etc. appearing on the Babeloo web, are protected by intellectual and industrial property rights and these rights are exclusively reserved by Babeloo or, if applicable, by the persons or companies named as authors or holders of such rights. Any violation of these rights will be pursued in accordance with current legislation. All reproduction, exploitation, distribution, alteration or public broadcasting in any medium for whatever reason apart from for legitimate purposes of information and bookings the service on offer by genuine users of any part of the content of the Babeloo web is therefore forbidden. In any case Babeloo’s prior consent in writing is needed.

Unauthorized use by third parties of this intellectual property will entail criminal and/or civil liabilities in law. Babeloo will not be held responsible for infractions by the webpage user, affecting the rights of third parties.

Policy of confidentiality and data protection

When you enter into a contract via the webpage, whether by e-mail or by use of the contact form, the personal data we collect will be used exclusively for the services requested by the user and to charge for these services.

The data that the user dispatches via the Babeloo web or the information is protected by the most modern electronic security techniques on the network. The data supplied and stored in our databases are also protected by security systems that deny access to the data to unauthorized third parties. Babeloo does its utmost to use the most up-to-date systems to maintain the performance of its security system.

In accordance with the Spanish Ley Orgánica 15/1999, of December 13th covering the Protection of Personal Data (LOPD in Spanish), we inform you that personal data provided by Babeloo.es users when making a booking or a registration will be subject to automated  processing and will be incorporated in automated files registered with the Registro General de Protección de Datos de la Agencia Española de Protección e Datos (= the Spanish Data Protection Agency’s General Register of Data Protection). The holder with responsibility for the automated files  is Babeloo with head offices on Via Augusta 236 ,6ª A, 08021  Barcelona.

Jurisdiction

The parties to this contract renounce their own areas of jurisdiction if possible, and agree to be bound by the Courts and Tribunals of Barcelona. The law applied to all cases will be Spanish law.

Babeloo compromises not to circulate personal data of customers binding to our service, or possible members who has booked through intermediary.  The information provided to Babeloo, can be used by the distribution partners (tourism and travel agencies), and by the hotels and riads that are members.
